Terms of Service

Welcome to Fox2D. These Terms of Service ("Terms") govern your use of the Fox2D website and App Maker service (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account, uploading files, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Fox2D provides an App Maker service that converts Scratch 3.0 projects (.sb3 files) into native applications for Android and other platforms. The Service includes:

Converting Scratch projects to native apps
Uploading .sb3 files or providing Scratch project URLs
Customizing app metadata (name, package name, version)
Uploading custom app icons
Generating downloadable .apk files for Android devices

Important Service Limitations:

Only Scratch 3.0 public shared projects are supported
Uploaded files (.sb3 and icons) are automatically deleted after 24 hours
Generated APK files are automatically deleted after 7 days
Rate limiting: Maximum 30 uploads per 10 minutes per user
File size limits: .sb3 files (max 300MB), icons (max 256KB)

3. Eligibility

To use the Service, you must:

Be at least 13 years old (or 16 years old if located in the European Union)
Have a valid Discord or Google account for authentication
Comply with all applicable laws and regulations in your jurisdiction
Not be prohibited from using the Service under applicable law

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

4.1 Account Creation

You can create an account using Discord or Google OAuth. You are responsible for maintaining the security of your authentication credentials.

4.2 Account Responsibility

You are solely responsible for all activities that occur under your account. You agree to:

Keep your account credentials secure
Notify us immediately of any unauthorized access
Not share your account with others
Not create multiple accounts to circumvent rate limits

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, including but not limited to:

Uploading prohibited content
Attempting to abuse or exploit the Service
Violating intellectual property rights
Engaging in fraudulent or illegal activities

5. Acceptable Use

5.1 Permitted Use

You may use the Service to convert your own Scratch projects or projects you have permission to use.

5.2 Prohibited Activities

You agree NOT to:

Upload malicious code, viruses, or harmful software
Infringe upon copyrights, trademarks, or other intellectual property rights
Upload content that is illegal, obscene, threatening, or harassing
Reverse engineer, decompile, or attempt to extract the source code of the Service
Use automated tools to abuse the Service or circumvent rate limits
Upload Scratch projects you do not have permission to use
Use the Service for commercial purposes without authorization
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any systems or networks

5.3 Content Requirements

Scratch projects you upload must:

Be Scratch 3.0 format (.sb3)
Be publicly shared on Scratch (if using project URL)
Comply with Scratch Community Guidelines
Not contain prohibited or illegal content

6. Intellectual Property

6.1 Your Content

You retain all ownership rights to your Scratch projects and uploaded content. By uploading content to the Service, you grant Fox2D a limited, non-exclusive, royalty-free license to:

Process and convert your Scratch projects into native applications
Store your uploaded files temporarily (automatically deleted after 24 hours)
Store generated APK files temporarily (automatically deleted after 7 days)
Generate and provide downloadable app files to you

This license terminates when your files are automatically deleted (uploaded files after 24 hours, APK files after 7 days).

6.2 Fox2D Platform

The Service, including all software, technology, designs, and trademarks, is owned by Fox2D and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.

6.3 Third-Party Content

Scratch is a trademark of the MIT Media Lab. Fox2D is not affiliated with, endorsed by, or sponsored by MIT or the Scratch Team. Users must comply with Scratch's terms of use and community guidelines.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Guarantees that generated apps will function perfectly on all devices
Guarantees of uninterrupted or error-free service
Warranties regarding the accuracy or completeness of content

Fox2D does not guarantee that:

All Scratch projects will convert successfully
Generated apps will be compatible with all Android devices or versions
The Service will meet your specific requirements
Build processes will always complete without errors

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOX2D SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or errors in app generation
Damages arising from user-uploaded content or generated apps
Unauthorized access to or alteration of your transmissions or data

You acknowledge that you use the Service at your own risk. You are solely responsible for any apps you generate and distribute using the Service.

9. Copyright and DMCA Policy

Fox2D respects intellectual property rights. If you believe content on our Service infringes your copyright, please contact us through Discord with the following information:

Identification of the copyrighted work claimed to be infringed
Identification of the infringing material and its location
Your contact information
A statement of good faith belief that the use is not authorized
A statement that the information is accurate and you are authorized to act

We will respond to valid DMCA notices and may remove infringing content or terminate repeat infringers' accounts.

10. Service Modification and Termination

10.1 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

10.2 User Termination

You may stop using the Service at any time. You may request account deletion by contacting us through Discord.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fox2D and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any rights of another party
Content you upload or apps you generate using the Service

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service should first be addressed by contacting us through Discord. We encourage good faith efforts to resolve disputes informally.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fox2D regarding the Service.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
